SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to advertising e-mails

The use of contact data published within the scope of the imprint obligation to send advertising and information material that has not been expressly requested is hereby prohibited. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails.

4. Data collection on this website

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The collection of this data is based on Art. 6 para. 1 lit. f DSGVO (GDPR). The website operator has a legitimate interest in the technically error-free presentation and optimisation of the website - for this purpose, the server log files must be recorded.

Cookies

Our web site uses so-called "cookies". Cookies are small data packets and do not cause any damage to your end device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies can be used to evaluate user behaviour or for advertising purposes.

Cookies that are necessary to carry out the electronic communication process, to provide certain functions that you have requested (e.g. for the shopping basket function) or to optimise the website (e.g. cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6 (1) lit. f DSGVO (GDPR), unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. Insofar as consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 para. 1 lit. a DSGVO (GDPR) and § 25 para. 1 TTDSG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and allow cookies only on a case-by-case basis, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. If you deactivate cookies, the functionality of this website may be limited.

You can find out which cookies and services are used on this website in this privacy policy.

Consent with Usercentrics

This website uses the consent technology of Usercentrics to obtain your consent to the storage of certain cookies on your end device or to the use of certain technologies and to document this in compliance with data protection regulations. The provider of this technology is Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, website: https://usercentrics.com/de/ (hereinafter "Usercentrics").

When you enter our website, the following personal data is transferred to Usercentrics:

  • Your consent(s) or the revocation of your consent(s)
  • Your IP address
  • Information about your browser
  • Information about your terminal
  • Time of your visit to the website

Furthermore, Usercentrics stores a cookie in your browser in order to be able to allocate the granted consents or their revocation. The data collected in this way is stored until you request us to delete it, delete the Usercentrics cookie yourself or the purpose for storing the data no longer applies. Mandatory legal retention obligations remain unaffected.

The Usercentrics banner on this website was configured with the help of eRecht24. You can recognise this by the fact that the eRecht24 logo appears in the banner. To display the eRecht24 logo in the banner, a connection to the eRecht24 image server is established. In the process, the IP address is also transmitted, but this is only stored in anonymised form in the server logs. The eRecht24 image server is located in Germany with a German provider. The banner itself is provided exclusively by Usercentrics.

Usercentrics is used to obtain the legally required consent for the use of certain technologies. The legal basis for this is Art. 6 para. 1 lit. c DSGVO (GDPR).

Job processing

We have concluded a contract on order processing (AVV) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that this service only processes the personal data of our website visitors in accordance with our instructions and in compliance with the DSGVO (GDPR).

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 (1) lit. b DSGVO (GDPR) if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the enquiries addressed to us (Art. 6 para. 1 lit. f DSGVO (GDPR)) or on your consent (Art. 6 para. 1 lit. a DSGVO) if this has been requested; the consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after processing your enquiry has been completed). Mandatory legal provisions - in particular retention periods - remain unaffected.

Requests by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of processing your request. We will not disclose this data without your consent.

6 para. 1 lit. a DSGVO (GDPR)) if this has been requested; the consent can be revoked at any time.

The data you send to us via contact requests will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, length of stay, operating systems used and the origin of the user. This data is assigned to the respective end device of the user. An assignment to a user ID does not take place.

Furthermore, Google Analytics allows us to record your mouse and scroll movements and clicks, among other things. Furthermore, Google Analytics uses various modelling approaches to complement the data sets collected and uses machine learning technologies in the data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.

The use of this service is based on your consent according to Art. 6 para. 1 lit. a DSGVO (GDPR) and § 25 para. 1 TTDSG. The consent can be revoked at any time.

6. Tools

YouTube with extended data protection

This website embeds videos from the website YouTube. The operator of the pages is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the disclosure of data to YouTube partners is not necessarily excluded by the extended data protection mode. Thus, YouTube - regardless of whether you watch a video - establishes a connection to the Google Marketing Network.

As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. The YouTube server will be informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, after starting a video, YouTube may store various cookies on your end device or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve the user experience and prevent fraud attempts.

If applicable, further data processing operations may be released after the start of a YouTube video over which we have no control.

YouTube is used in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO (GDPR). If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO (GDPR) and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. The consent can be revoked at any time.

For more information about privacy at YouTube, please see their privacy policy at: https://policies.google.com/privacy?hl=de.

The company is certified according to the "EU-US Data Privacy Framework" (DPF). The DPF is an agreement between the European Union and the USA, which is intended to ensure compliance with European data protection standards for data processing in the USA. Any company certified under the DPF undertakes to comply with these data protection standards. For more information, please contact the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt000000001L5AAI&status=Active

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to check whether data is entered on this website (e.g. in a contact form) by a human or by an automated programme. For this purpose, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, time spent on the website by the website visitor or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place.

The data is stored and analysed on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its website from abusive automated spying and SPAM. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) as defined by the TTDSG. Consent can be revoked at any time.

For more information about Google reCAPTCHA, please refer to the Google Privacy Policy and the Google Terms of Use at the following links: https://policies.google.com/privacy?hl=de and https://policies.google.com/terms?hl=de.

The company is certified in accordance with the "EU-US Data Privacy Framework" (DPF). The DPF is an agreement between the European Union and the USA that is intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information on this can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt000000001L5AAI&status=Active

7. Newsletter

Newsletter data

In order to inform our dealers and customers about new products and activities, we offer a B2B newsletter which is sent by e-mail. If you purchase goods and enter your e-mail address, this can subsequently be used by us to send you a newsletter. The e-mail address provided during registration for the Miller area can also be used for this purpose. In such a case, only direct advertising and information will be sent via the newsletter. Only the e-mail address is collected as personal data for sending the newsletter. The data is used exclusively for sending the newsletter.

We use newsletter service providers to handle the newsletters, which are described below.

CleverReach

This website uses CleverReach to send newsletters. The provider is CleverReach GmbH & Co KG, Schafjückenweg 2, 26180 Rastede, Germany (hereinafter "CleverReach"). CleverReach is a service with which the newsletter dispatch can be organised and analysed. The data you enter for the purpose of receiving newsletters (e.g. email address) is stored on CleverReach's servers in Germany or Ireland.

Our newsletters sent with CleverReach allow us to analyse the behaviour of the newsletter recipients. Among other things, we can analyse how many recipients have opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analysed whether a predefined action (e.g. purchase of a product on this website) has taken place after clicking on the link in the newsletter. For more information on data analysis through CleverReach newsletters, please visit: https://www.cleverreach.com/de/funktionen/reporting-und-tracking/.

The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO (GDPR)). If you are a customer, the legal basis is Art. 6 para. 1 lit. f DSGVO (GDPR) in conjunction with. §7 para. 3 UWG (direct marketing).

If you no longer wish to receive a newsletter (or do not wish to have it analysed by CleverReach), you can unsubscribe from our newsletter at any time (without incurring additional costs above the basic charges). Each newsletter email contains a link to unsubscribe for this purpose. You can declare the objection by clicking on this link or by sending us a corresponding message to the above-mentioned contact details of this privacy policy.

The lawfulness of the data processing operations already carried out remains unaffected. The data entered to set up the subscription will be transferred to an internal blacklist in the event of unsubscription and will no longer be used for sending newsletters.

If you do not want any analysis by CleverReach, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message.

The data you provide us with for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data that has been stored by us for other purposes remains unaffected by this.

After you have unsubscribed from the newsletter distribution list, your email address will be stored by us or the newsletter service provider in a blacklist if necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO (GDPR)). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

For more details, please refer to CleverReach's privacy policy at: https://www.cleverreach.com/de/datenschutz/.

Job processing

We have concluded a contract on order processing (AVV) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that this service only processes the personal data of our website visitors in accordance with our instructions and in compliance with the DSGVO (GDPR).

8. Applications

Handling of applicant data

We offer you the opportunity to apply to us (e.g. by e-mail, post or via the online application form). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other legal provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

We use the onapply software from the service provider On-apply GmbH, Schumannsgtraße 27, 60325 Frankfurt am Main, Germany, to display job advertisements and manage applications received. We have concluded a data processing agreement (DPA) with On-apply for the use of the service. This is a contract prescribed by data protection law, which ensures that On-apply processes the personal data of our applicants only in accordance with our instructions and in compliance with the GDPR.

When you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) to the extent that this is necessary to decide whether to establish an employment relationship. The legal basis for this is § 26 BDSG (German Federal Data Protection Act) (initiation of an employment relationship), Art. 6 para. 1 lit. b DSGVO (GDPR) (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a DSGVO (GDPR). The consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 (1) lit. b DSGVO (GDPR) for the purpose of implementing the employment relationship.

Retention period of the data

If we are unable to make you a job offer, if you reject a job offer or withdraw your application, we reserve the right to retain the data you have provided on the basis of our legitimate interests (Art. 6 para. 1 lit. f DSGVO (GDPR)) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. This storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for continued storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a DSGVO (GDPR)) or if legal storage obligations prevent deletion.

Admission to the applicant pool

If we do not make you a job offer, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies.

Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 para. 1 lit. a DSGVO (GDPR)). The provision of consent is voluntary and is not related to the current application process. The person concerned can revoke his/her consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, unless there are legal reasons for retention.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.

9. Miller area

On our website, we offer an area exclusively for our existing miller business customers, who have access to information and download materials, the viewing and use of which is reserved exclusively for them as a customer group. The prerequisite for registration is inclusion in our customer base. Registration for the use of the Miller area is made in writing. The data collected during registration, if not already available to us, will be used to set up access for our customers. In the event of important changes, for example in the scope of the offer or in the event of technically necessary changes, we will use the e-mail address provided during registration to inform you in this way. In addition, the e-mail address provided during registration may be used for direct marketing purposes, such as sending a newsletter. The data will not be passed on to third parties. The following data is collected as part of the registration process:

  • Salutation
  • First name, last name
  • Company
  • Street, house number
  • Postcode, city, country
  • E-mail address

In addition, we collect the following data when you use the Miller area:

  • User name
  • Registration and deregistration
  • Time of your downloads

Legal basis for data processing

The processing of the data entered during registration is carried out for the purpose of implementing the user relationship established by registration and, if necessary, for initiating further contracts (Art. 6 para. 1 lit. b DSGVO (GDPR)).

Nature and purpose of data processing

User registration is required for the provision of certain content and services on our website. For example, registered users will find download materials in the Miller area that are not made available to end customers.

Duration of storage

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were processed.

This is the case for the data collected during the registration process when the registration on our website is cancelled or modified.

The data collected during registration will be stored by us for as long as you are registered on this website and will then be deleted. Legal retention periods remain unaffected.

To delete your account or change your details, simply send an informal message to the above contact details of the person responsible.

Order form

In the Miller section of our website, we provide an online form for orders. If a user takes advantage of this option, the data entered in the input mask will be transmitted to us and stored. These data are:

  • First name, last name

  • Customer number

The following data is also stored at the time the message is sent:

  • IP address of the user

The legal basis for processing the information from the form is Art. 6 para. 1 lit. b DSGVO (GDPR) (pre-contractual measures or execution of a contract). We retain the information for the duration of the statutory retention periods. The information will not be passed on to third parties.

10. Our social media presence

Data processing by social networks

We maintain publicly accessible profiles on social networks. The specific social networks we use can be found below.

Social networks such as Facebook, X (former Twitter), etc. can usually comprehensively analyse your user behaviour when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). By visiting our social media presences, numerous data protection-relevant processing operations are triggered. In detail:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected under certain circumstances if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection takes place, for example, via cookies that are stored on your end device or by recording your IP address.

With the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are or were logged in.

Please also note that we cannot track all processing operations on the social media portals. Depending on the provider, further processing procedures may therefore be carried out by the operators of the social media portals. For details, please refer to the terms of use and data protection provisions of the respective social media portals.

Legal basis

Our social media presence is intended to ensure the most comprehensive presence possible on the internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO (GDPR). The analysis processes initiated by the social networks may be based on different legal grounds, which are to be stated by the operators of the social networks (e.g. consent within the meaning of Art. 6 para. 1 lit. a DSGVO (GDPR)).

Responsible person and assertion of rights

If you visit one of our social media sites (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. In principle, you can assert your rights (information, correction, deletion, restriction of processing, data portability and complaint) against both of us and the operator of the respective social media portal (e.g. Facebook).

Please note that despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

Storage period

The data collected directly by us via the social media presence will be deleted from our systems as soon as you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal provisions - in particular retention periods - remain unaffected.

We have no influence on the storage period of your data, which is stored by the operators of the social networks for their own purposes. For details, please contact the operators of the social networks directly (e.g. in their privacy policy, see below).

Your rights

You have the right at any time to receive information free of charge about the origin, recipient and purpose of your stored personal data. You also have the right of objection, the right to data portability and the right to lodge a complaint with the competent supervisory authority. Furthermore, you can demand the correction, blocking, deletion and, under certain circumstances, the restriction of the processing of your personal data.
